FAMILY LAW
The firm's lawyers have extensive experience in all
areas of family law, including divorce, property
settlement, child custody and visitation, child support,
spousal support, adoption, separation agreements,
and children's rights.

LITIGATION
Commercial Litigation:
The firm's lawyers have handled trial level litigation and appeals before state and federal courts in Idaho and in other states. They have experience and expertise in all facets of complex litigation, including prosecution and defense of claims under the Racketeer Influenced and Corrupt Organizations (RICO) Act and state Racketeering Acts, and lawsuits involving financial crimes and fraud, products liability, professional liability, minority shareholder oppression, insurance bad faith, securities violations, tax disputes with state and federal governments and breach of contract and breach of the covenant of good faith and fair dealing.
Tort Litigation:
The firm has represented clients in many different cases involving tort litigation, including medical malpractice, nursing home negligence, insurance bad faith, products liability, emotional injury, breach of fiduciary duties, fraud and misrepresentation and conversion (the civil equivalent of embezzlement).
Securities Litigation:
The firm is also available to represent clients with regard to disputes with securities regulators and for clients with claims against securities brokers and broker dealers in cases involving all manner of deceptive practices, including churning and unsuitable investments.
Tax Disputes:
An active part of Cosho Humphrey's tax practice
involves administrative appeals before the IRS and
Idaho State Tax Commission. We are also
experienced in representing clients in state and
federal courts in litigation involving the IRS and
Idaho State Tax Commission.
Real Estate Disputes:
The firm represents buyers, sellers, developers,
landlords, tenants and owners in a wide variety of
real estate disputes, including: complex commercial/industrial/retail landlord/tenant disputes; quiet title actions, including adverse possession disputes, boundary disputes and access disputes; private and public condemnations; easement and right of way disputes; disclosure disputes (known and unknown conditions); specific performance of contracts; broker commission disputes; escrow/earnest money disputes; and trespass/nuisance claims.
BANKRUPTCY
The firm's bankruptcy and commercial law practice is experienced in representing large financial institutions, consumer lenders, secured creditors, and a variety of debtors ranging from large farming industries to individual consumer debtors. Cosho Humphrey, LLP is also experienced in a variety of financial workouts, including foreclosure, and reorganizations, as well as bankruptcy. Cosho Humphrey, LLP is experienced in restructuring commercial and individual reorganization.
The firm's bankruptcy and commercial litigation practice is headed by Joe Meier. Joe has over 20 years of experience in civil litigation matters and is licensed to practice in federal and state courts in Idaho and Oregon. Joe is also very involved in the commercial law bankruptcy section of the Idaho State Bar and has given seminars regarding bankruptcy, and recently, the enactment of the new bankruptcy statute.
PLANNING
Tax Planning, Estate Planning and Probate:
Cosho Humphrey, LLP is also actively involved in counseling clients in the full range of tax planning issues. The orderly transfer of a closely held
business requires special planning to reduce
federal and state taxes and to avoid unnecessary
disruption to the company's activities. Our attorneys
can assist in designing and implementing plans that
enable businesses to continue operations without
interruption while minimizing their tax burden.
The firm's lawyers have designed wills, trusts, and
other estate planning vehicles to meet clients' special
needs for privacy and discretion while helping to
achieve estate and income tax savings. The firm has
a long history of providing timely personal service
to individuals and their families concerned with the
preservation, administration, and distribution of their assets.
Our attorneys also assist clients with guardianship, conservatorship, and other probate matters, including litigation of adversarial proceedings in probate court. We provide counsel in trust administration and probate matters for individual and corporate trustees and personal representatives throughout Idaho.
TRANSACTIONS
Tax:
The firm provides legal advice regarding taxation that is timely and meaningful to personal and business affairs. We serve individuals as well as small- and medium-sized businesses in designing creative and practical solutions to mitigate taxes in complex personal and business transactions.
The firm is well versed in the tax aspects involved with mergers and acquisitions, asset sales, stock sales and redemptions, partnerships, limited liability companies, and limited liability partnerships. We can advise on structuring or restructuring privately-held or family-owned business for the maximum tax benefit.
Real Estate Transactions:
The firm represents buyers and sellers in the purchase and sale of real estate throughout Idaho. We have handled many sophisticated real property contracts and option agreements.
The firm also represents both landlords and tenants in negotiation and preparation of leases. We handle office, retail, industrial, and other commercial property transactions. Our attorneys have many years of experience analyzing lease provisions, developing proactive and creative solutions, and drafting lease language to meet both the practical and economic needs of our clients.
The firm also advises clients with respect to tax-
deferred exchanges of real property interests under
Section 1031 of the Internal Revenue Code. The firm
is well-versed in assisting clients in obtaining the tax
and economic benefits of this important wealth
building technique.
Buying and Selling Businesses:
The firm has extensive experience is representing
buyers and sellers in both stock and asset sale
ransactions, mergers and acquisitions and divisive
reorganizations.
